General Terms and Conditions (GTC)

General Terms and Conditions (GTC) of RadSportUnion Maria Enzersdorf, Austria (hereinafter referred to as the „Organizer“), latest version.

By purchasing one or more tickets, the participant accepts these General Terms and Conditions, the Organizer’s Terms of Participation, and Privacy Policy. Any general terms and conditions of third parties shall not apply.

Any registration, booking, or purchase made via www.goodtimesgravel.at is legally binding and obliges the participant to accept and pay for the booked services.

The Organizer reserves the right at any time to modify the event schedule, the selection of program items, speakers, guides, or featured guests, as well as the routes of Good Times Gravel. Provided such changes are reasonable and objectively justified, they shall not entitle participants to a refund.

If the event date must be changed due to force majeure, all tickets will automatically remain valid for the replacement date offered. However, ticket holders may cancel their tickets free of charge by submitting written notice via email to the Organizer no later than one month before the replacement event.

Participants are not automatically entitled to compensation if one or more program items are cancelled or if the event venue can only be used partially (for example, due to force majeure). In the event of cancellation, postponement, route changes, or schedule changes for reasons beyond the Organizer’s control (including force majeure), the Organizer shall not reimburse any additional expenses incurred by participants, including but not limited to hotel accommodation, travel costs, bicycle rental, or similar expenses. The Organizer may communicate cancellations, postponements, or significant changes by email and/or via the official event website.

For the purposes of these Terms and Conditions, force majeure means any extraordinary event beyond the reasonable control of the Organizer that directly affects the event and renders it impossible, impracticable, or unsafe to hold. This includes, but is not limited to, terrorism, war, natural disasters, epidemics, pandemics, laws, regulations, official orders or decisions issued by national, international, or other competent authorities, including travel restrictions, entry restrictions, capacity limitations, or other measures that materially affect the economic feasibility or safe execution of the event. Epidemics or pandemics, as well as any official measures adopted in connection with them, shall constitute force majeure regardless of whether they were foreseeable.

Ticket returns (exchange or refund) are only possible in the event of a postponement and only until one month before the replacement event.

All legal requirements and any measures imposed by applicable laws, authorities, or the Organizer must be observed by all participants without exception. Participants who fail to comply with such requirements may be denied admission or removed from the event without compensation. In such cases, participants are neither entitled to a refund nor to any other claims against the Organizer.

If the event is cancelled in its entirety, tickets may be refunded. The refund procedure will be announced by the Organizer in due time on the official website. Processing fees and other service charges cannot be refunded, as the related contractual services have already been provided. Such fees may vary but are generally approximately 10% of the ticket price.

If, due to force majeure, the event cannot proceed at full capacity and participant numbers must be reduced (for example, due to safety regulations or legal attendance limits), the Organizer shall determine which participants may attend. Participants who cannot be accommodated as a result shall be entitled to a refund of the ticket price.

Tickets may not be misused, copied, altered, or reproduced. Any misuse may result in invalidation of the ticket and exclusion from the event. Participants are solely responsible for arranging their own travel to the event venue and for arriving on time.

Competitions, giveaways, raffles, or promotional distributions of tickets may only be conducted with the prior consent of the Organizer. If personalized tickets are transferable only under certain conditions, the Organizer will inform purchasers before the ticket purchase is completed.

Participants generally have no statutory right of withdrawal from the ticket purchase, as services related to leisure activities provided for a specific date or period are exempt from the right of withdrawal pursuant to Section 18 (1) No. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG).

Should participants exceptionally have a statutory right of withdrawal due to unforeseen circumstances, the following provisions shall apply:

The withdrawal period, unless excluded pursuant to Section 18 (1) No. 10 FAGG, is fourteen (14) days from the date of conclusion of the contract. To exercise the right of withdrawal, participants must notify the Organizer, RadSportUnion Maria Enzersdorf, Austria, by means of a clear declaration (for example by letter or email) of their decision to withdraw from the contract. Participants may use the model withdrawal form provided below, although this is not mandatory. It is sufficient that the notice of withdrawal is sent before the withdrawal period expires.

If the participant validly exercises a statutory right of withdrawal, all payments received, including any delivery costs, will be refunded no later than fourteen (14) days after receipt of the withdrawal notice. The participant’s entitlement to attend the event shall cease immediately. Refunds will be made using the same payment method used for the original transaction unless expressly agreed otherwise. No fees will be charged for processing the refund.

The Organizer reserves the right to amend these General Terms and Conditions where necessary to reflect changes in legal or economic circumstances. Any amendments will be sent to participants via the email address provided during registration. Such amendments shall be deemed accepted unless the participant objects in writing within one month of receiving the notification. The Organizer will expressly inform participants of this one-month objection period.

Should any provision of these Terms and Conditions become invalid or unenforceable, or should the agreement contain an unforeseen omission, the validity of the remaining provisions shall remain unaffected. Invalid or missing provisions shall be replaced by the applicable statutory provisions.

These General Terms and Conditions shall be governed exclusively by the laws of the Republic of Austria. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG), the conflict-of-law provisions of the Austrian Private International Law Act (IPRG), and Regulation (EC) No. 593/2008 of the European Parliament and of the Council (Rome I Regulation) is expressly excluded.

The exclusive place of jurisdiction shall be the court with subject-matter jurisdiction for Mödling, Austria.
